GENERAL TERMS AND CONDITIONS OF PURCHASE

Please review these General Terms and Conditions of Online Purchase, which govern the offering and purchase of products through our online store.

By using this website and carrying out any purchase process, you are bound by these General Terms and Conditions of Purchase, and therefore we recommend that you read them carefully. If you do not agree with them, you must refrain from purchasing any products on this page.

LEGAL INFORMATION AND ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF PURCHASE

1.2 Description

Through these General Terms and Conditions of Purchase, GALCON STUDIO, S.L. offers its users and visitors the possibility of purchasing the products and services offered online, as well as establishing communication with the user.

GALCON STUDIO, S.L. carries out its e-commerce activity as a virtual store through its website. This electronic platform offers seven product lines:

  • Tops

  • Skirts

  • Blouses

  • Dresses

  • Knitwear

  • Trousers

  • Outerwear

The marketing of the products included in the above business lines is governed by the following General Terms and Conditions of Purchase.

GALCON STUDIO, S.L. may alter at any time and without prior notice the design, presentation, and/or configuration of the website, as well as some or all of the services.

1.3 Acceptance of the Specific Terms of Purchase

Access to and use of the service imply full and unconditional acceptance by the User of all the conditions set forth in these General Terms and Conditions of Purchase. Likewise, GALCON STUDIO, S.L. reserves the unilateral right to modify these General Terms and Conditions at any time.

Any order placed with GALCON STUDIO, S.L. necessarily implies, as an essential, determining, and indispensable condition, the unconditional acceptance by the customer of the General Terms and Conditions of Purchase of its products in force on the day the corresponding order is placed. Furthermore, the customer acknowledges that acceptance of these General Terms and Conditions of Purchase will apply to the order to which they refer, as well as to any subsequent orders, except in cases where new conditions are communicated by GALCON STUDIO, S.L.

The fact that GALCON STUDIO, S.L. does not invoke, at any given time, any of these conditions may not be interpreted nor shall it constitute a waiver of invoking them in the past or future.

2. ONLINE PURCHASE PROCESS

2.1 Finding Our Products

www.galconstudio.com provides a virtual store that offers all types of products and services organized into families, to make it easier for you to find them.

From the homepage you can access all product categories. You can also find products using the search bar by entering a keyword (which may be the product name, features, or even incomplete words) and clicking the search button.

2.2 Product Categories

All products include a detailed product page containing a photograph, name, description, and price (including taxes). The prices shown constitute an invitation for the customer to make a purchase proposal; therefore, in the event of an error, GALCON STUDIO, S.L. will inform the customer and will not process the order.

Once selected, products are added to the Shopping Cart, where users may add or remove items at any time. Once the selection process is complete, or directly by clicking the “BUY” button, visitors can finalize the selection and proceed to payment.

2.3 Purchasing at www.galconstudio.com

To purchase, the user may register on our e-commerce platform through a registration form or purchase as a guest without prior registration.

To place an order through our platform, regardless of registration, the User must complete our form providing the following data:

  • Full name

  • Full postal address

  • Email address

  • Contact telephone number

Registered users may also receive information on offers and promotions (if desired) and track the status of their orders. Their personal data will be saved in their customer profile for future purchases. For more information on the processing and storage of personal data, please see our Privacy Policy.

2.4 Product Availability

The selection of products offered by GALCON STUDIO, S.L. is valid as long as the products are visible on the website. As an online store, stock is updated in real time, so it is possible that during the purchase process a product may sell out, making it impossible to complete the initiated transaction.

Each product page indicates availability:

  • In stock, dispatch within 24/72 hours. Item is in stock; shipping commitment is between 24/72 hours.

  • Check stock. If out of stock, delivery depends on production date; the customer will be informed of availability within 24/48 hours.

  • Out of stock. Temporarily unavailable.

Shipping times must be added to the above availability times. These timeframes are counted in working days (Monday to Friday). No shipments are made on holidays, Saturdays, or Sundays.

Dispatch times are indicative. In the event of stock shortages or unavailability of an item, GALCON STUDIO, S.L. will immediately contact the customer to provide a new delivery date or, if not possible, cancel the order. In any case, a delay in delivery does not entitle the customer to claim compensation.

2.5 Order Processing

Purchasing products requires clicking the “BUY” button, which expresses full acceptance of these General Terms and Conditions of Purchase prior to purchase.

After selecting products and quantities, by clicking “Process Order,” registered users will enter their username and password to access a personalized panel where they can modify shipping details and select shipping and payment methods. Guest users will be asked for their personal details to process the order and delivery.

2.6 Prices

Applicable prices (including VAT) are those shown on the product page. Taxes and shipping costs will be itemized before order confirmation.

Offers will be clearly marked and identified, showing the previous price and the offer price.

GALCON STUDIO, S.L. reserves the right to make changes at any time without prior notice, updating products and services daily according to market conditions.

Shipping costs are always indicated in the order.

For shipments to countries outside the European Union, GALCON STUDIO, S.L. will not assume costs related to taxes and customs duties in each country.

If a price variation occurs, GALCON STUDIO, S.L. will inform the customer by email, and the customer may choose to cancel the order without incurring additional costs.

2.7 Payment Methods

GALCON STUDIO, S.L. offers several payment methods for customers to choose from:

  • Credit Card (Visa, MasterCard, American Express): Secure online payment system requiring card issuer authentication. GALCON STUDIO, S.L. reserves the right to reject any credit card transaction. In such cases, funds will be refunded to the original card.

  • Secure SSL Connection: For card payments, a secure SSL connection is established; payment confirmation and banking data are entered directly into an external payment gateway. GALCON STUDIO, S.L. does not access or store banking data.

  • PayPal Account: Secure payment system acting as an intermediary between the customer and GALCON STUDIO, S.L. Payment is immediate upon execution. For more information, visit www.paypal.es.

2.8 Non-Payment

If total or partial non-payment occurs on the due date, GALCON STUDIO, S.L. may suspend or cancel any shipment without liability for damages or losses, including lost profits or production delays. This does not release the customer from contractual payment obligations or product receipt.

2.9 Invoicing

GALCON STUDIO, S.L. is obliged to issue an invoice to customers who request it. This invoice will include the details of the sums collected for the shipped orders.

2.10 Transport and Shipping Costs

Shipping and/or handling costs are not included in the product price and will be shown to the customer before finalizing the purchase, depending on the shipping address.

Orders over €200 benefit from free shipping. For all other orders, flat-rate shipping applies:

  • Mainland Spain: €6

  • Balearic Islands: €12

  • Canary Islands: €17

GALCON STUDIO, S.L. is not responsible for delays caused by:

  • Incorrect or incomplete address

  • Failure to provide a contact telephone number

  • Carrier strikes or force majeure

If the customer does not notice external damage upon delivery but finds damage caused during transport after opening the package, they must notify the transport company within 24 hours to record the issue and contact GALCON STUDIO, S.L. Otherwise, the product will be deemed accepted. After this period, the carrier considers the goods to be in perfect condition and is not responsible for possible defects.

2.11 Product Delivery

Products are sent to the shipping address indicated by the customer. If an order contains items with different availabilities, dispatch time will consider the longest delivery time. Carriers do not deliver on Saturdays, Sundays, or holidays.

It is not possible to arrange specific delivery times. Delivery is 2–3 working days for immediately available products and 3–7 working days for non-immediate products.

In exceptional cases, GALCON STUDIO, S.L. reserves the right to split the order, sending available items first and pending items later. GALCON STUDIO, S.L. will not ship any product until its Administration Department has verified payment.

If the customer detects any problem upon delivery (damaged packaging, defective products, missing or damaged items), they must note it in writing on the carrier’s delivery slip and notify GALCON STUDIO, S.L. by email at info@galconstudio.com within 24 hours of receipt.

No return of damaged items or claims for missing items will be accepted if not communicated within the established period, without prejudice to the customer’s statutory warranty rights for nonconforming products.

3. ORDER CHANGES, CANCELLATIONS AND RETURNS

3.1 Changes

The customer may modify an order provided it has not yet been dispatched. For any change, please notify us as soon as possible by email at info@galconstudio.com, indicating the desired changes.

Changes are not permitted for products made to measure, customized, or produced according to the customer’s specifications.

3.2 Cancellations

Orders may be cancelled in whole or in part up to 48 hours before the agreed delivery date. For any cancellation, please notify us as soon as possible by email at info@galconstudio.com.

If the cancellation is made within the specified period, no penalty will apply. If the cancellation is made later than 48 hours before the agreed delivery date, the customer will no longer be able to cancel the order or, where applicable, will be charged a late cancellation fee of €6.

If an order is cancelled after it has already been confirmed and dispatched, the customer must bear the transport and handling costs incurred.

Cancellations are not permitted for products made to measure, customized, or produced according to the customer’s specifications.

As a result of a cancellation eligible for a refund, the purchase amount will be reimbursed using the same payment method used for the initial transaction, unless expressly agreed otherwise.

For credit cards, the amount will be refunded at the end of the monthly billing period. The exact refund date depends on the agreement between the issuing bank and the customer. Refunds via bank transfer will be made within seven working days, or as stipulated by the corresponding bank.

Any difference in amount between the original order and the modified order will be processed following the procedure corresponding to the selected payment method. Return and new shipping costs will not be covered by GALCON STUDIO, S.L.

GALCON STUDIO, S.L. may not substitute a product or model without prior consultation with the customer. If, for reasons beyond the control of GALCON STUDIO, S.L., the order cannot be supplied, the customer will be offered the option to exchange it for a substitute product of similar characteristics or to cancel the order.

3.3 Returns

Orders may be returned within 14 days from the purchase date. To do so, the customer must contact GALCON STUDIO, S.L. by email at info@galconstudio.com.

Conditions for Returns:

  • The product must not have been used and must be returned in the original packaging received, including original tags and stickers. Products that have been modified cannot be returned.

  • The customer must have the purchase invoice. If unavailable, the purchase must be recorded in GALCON STUDIO, S.L.’s database.

  • The customer is responsible for return shipping costs, which must be paid directly to the transport company at the time of collection. No goods sent “freight collect” will be accepted.

  • The item to be returned must be properly packaged.

  • Original shipping costs will not be refunded.

Grounds for Product Returns:

  • The product does not match the specifications shown on our website. In this case, the product price will be refunded (excluding shipping costs) using the customer’s original payment method.

  • The product is defective from origin. In this case, it will be exchanged for the same item once the returned product is received. GALCON STUDIO, S.L. will cover the return and reshipping costs.

Once the goods have been received at our warehouse and it has been verified that the item meets the required return conditions, we will refund the purchase amount using the same payment method used for the purchase.

4. RIGHT OF WITHDRAWAL

The customer has the right to withdraw from the purchase within 14 calendar days without giving any reason, for all orders that have not been made to measure or following the customer’s instructions.

The withdrawal period will expire 14 calendar days from the day on which the customer, or a third party indicated by the customer other than the carrier, receives the order.

4.1 Products not subject to the right of withdrawal

In the case of orders made to measure or according to the customer’s instructions, section (c) of Article 103 of Royal Legislative Decree 1/2007 of 16 November applies, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, which states:

“The right of withdrawal shall not apply to contracts relating to:
(c) The supply of goods made to the consumer’s and user’s specifications or clearly personalised.”

Accordingly, for products made to measure and/or personalised products according to the customer’s instructions, the customer may not exercise the right of withdrawal.

4.2 How to exercise the right of withdrawal

To exercise the right of withdrawal, the customer must send the withdrawal form, available in this section, to GALCON STUDIO, S.L. by any of the following means:

To meet the withdrawal deadline, it is sufficient for the communication concerning the exercise of the right to be sent before the withdrawal period expires.

In the event of withdrawal, all payments received will be refunded. However, the customer must bear the direct cost of returning the goods.

Payment will be made without undue delay and, in any event, no later than 14 calendar days from the date on which the customer informs us of the withdrawal. The refund will be made using the same payment method used for the initial transaction unless expressly agreed otherwise; in any event, the customer will not incur any fees as a result of the refund.

5. WARRANTIES

All products have a two-year warranty from the date of delivery. This warranty does not cover deficiencies caused by negligence, impacts, improper use or unauthorised handling. The warranty will also be void if the purchase invoice is missing.

Unless proven otherwise, any lack of conformity that becomes apparent within six months of delivery of the product will be presumed to have already existed at the time of delivery, except when this presumption is incompatible with the nature of the product or the nature of the lack of conformity.

The warranty will be invalid under the following circumstances:

  • Damage caused by impacts and/or improper transport

  • Fault or negligence of the customer or a third party

  • Improper use

  • Damage resulting from force majeure

6. CUSTOMER RESPONSIBILITY

The customer undertakes to use the services lawfully, without contravening current legislation or infringing the rights and interests of third parties.

The customer guarantees the truthfulness and accuracy of the data provided when completing the order forms, avoiding harm to GALCON STUDIO, S.L. as a result of incorrect information.

The customer also undertakes to facilitate the delivery of the requested order by providing a delivery address where the order can be received during normal delivery hours (Monday to Friday from 10:00 to 13:30 and from 16:00 to 19:00).

Failure to comply with any of these General Conditions of Contract may result in the cancellation of orders by GALCON STUDIO, S.L. without prior notice to the customer and without entitling the customer to any compensation.

If the shipment is refused by the customer, GALCON STUDIO, S.L. will not refund the shipping costs, which will be borne by the customer.

8. PERSONAL DATA AND COMMERCIAL COMMUNICATIONS

We remind you that GALCON STUDIO, S.L. complies with current data protection regulations. In accordance with Organic Law 3/2018 of 5 December and EU Regulation 679/2016 General Data Protection Regulation (GDPR), we inform you about the processing of personal data we carry out.

8.1 Who is responsible for your data?

The data controller for the information you provide as a result of purchasing a product or completing a form is:

8.2 What data do we process?

Depending on the products and services you wish to enjoy at any given time, we may process personal data such as:

  • Identification data: your name and surname, contact address, email address, telephone number.

  • Economic and transactional information: your payment method details, information about your purchases, orders, returns, cancellations, among others.

  • Commercial and promotional information if you have subscribed to our communication system.

  • Information about your preferences and interests.

In our forms, you will find that we request necessary data marked with an asterisk, which we need in order to provide the service. If you do not provide such data, it may not be possible to complete your registration or continue with the purchase process.

8.3 What is the purpose for which we process your data?

Depending on how you interact with us, we will process your data for the following purposes:

8.5 How long will we keep your data?

8.6 Who do we share your data with?

Unless indicated otherwise in the form, GALCON STUDIO, S.L. expressly informs you that it will only communicate data to those bodies and public administration entities with competence in the matter in accordance with current legal regulations, and to fulfil the sales contract we will need to provide your data to third-party companies for the following purposes:

  • Financial institutions and credit/debit card issuers, for the management of collections and payments.

  • Fraud detection and prevention entities.

  • Transport and delivery service providers and partners.

  • Providers and partners for invoicing, accounting and tax management services.

8.7 What are your rights?

Under current EU (Regulation 679/2016, 27 April) and Spanish (Organic Law 3/2018, 5 December) regulations you may exercise the following personal rights, reliably proving your identity, either electronically or in writing addressed to our Data Protection Officer:

  • Right to revoke your consent and request that we do not process your personal data for commercial purposes, nor send you communications by email, SMS or newsletter.

  • Right of access to the information we hold about you, specifying the purposes of the processing we carry out and the communications we have made to third-party administrations and companies, either because they are authorised by law, necessary for the service you requested, or because you gave your prior consent.

  • Right to rectification of your data, by which we will update and bring up to date the information and data we hold according to the information you provide.

  • Right to erasure of your data, once the legal retention periods established by applicable regulations have been met.

  • Right to object to any processing activity of your data, through the revocation of your authorisation/consent.

  • Right to limit the processing of your data, such as when you lodge a complaint or wish us to keep your data for a longer period, avoiding its deletion.

  • Right to data portability, whereby we will provide you in a commonly readable file format with the data you provided to us when registering as a user.

You may also contact the Spanish Data Protection Authority (Agencia Española de Protección de Datos, www.aepd.es) to request their protection or file a complaint regarding the processing of personal data.

8.8 Where to exercise your rights?

To exercise these rights, you may contact us by sending us a letter with a copy of your ID to the address indicated at the start of this text.

8.9 Security of your data

We have organisational and technical measures to protect your personal data from any loss, misuse, unauthorised access or disclosure, alteration and/or destruction. Unfortunately, it is not possible to fully guarantee the security of any data transmission or storage system.

9. INDUSTRIAL AND INTELLECTUAL PROPERTY

The intellectual and industrial property rights over the works, trademarks, logos, and any other protectable content on the website belong exclusively to GALCON STUDIO, S.L., unless otherwise indicated.

Unauthorised reproduction, distribution, commercialisation or transformation of such works, trademarks, logos, etc. constitutes an infringement of the intellectual and industrial property rights of GALCON STUDIO, S.L. or their holders and may give rise to the exercise of judicial or extrajudicial actions in the defence of their rights.

Likewise, the information the customer may access through the website may be protected by industrial, intellectual or other property rights. The company shall not be responsible in any case for any infringements of such rights committed by you as a user and/or customer.

10. NOTIFICATIONS

All notifications, requirements, requests and other communications between the parties in relation to these General Terms and Conditions of Purchase must be made in writing and shall be deemed to have been duly sent by ordinary mail to the address of the other party or their email address.

Specifically, in the case of GALCON STUDIO, S.L., it must be notified at the address indicated at the start of this text.

11. NULLITY AND INEFFECTIVENESS OF CLAUSES

If any clause included in these Particular Conditions of Contracting is declared totally or partially null or ineffective, such nullity or ineffectiveness shall affect only that provision or the part of it that is null or ineffective, and the rest of the General Conditions of Purchase shall remain in force. Consequently, the clause declared totally or partially null or ineffective shall be deemed not to have been included.

12. APPLICABLE LAW AND JURISDICTION

Sales made at the company are subject to Spanish law.

In the event of any conflict or discrepancy in the interpretation or application of these contractual conditions, GALCON STUDIO, S.L. submits to the consumer arbitration system / to the Courts and Tribunals that, where appropriate, shall hear the matter, and which shall be those provided for by the applicable legal regulations on competent jurisdiction: in the case of end consumers, at the place of performance of the obligation or at the domicile of the purchasing party.

If the purchasing party acts on behalf of a legal entity, both parties submit, with express waiver of any other jurisdiction, to the Courts and Tribunals of Madrid.
