Through these General Terms and Conditions of Purchase, GALCON STUDIO, SL offers its users and visitors the opportunity to purchase the products and services offered online, in addition to establishing communication with the user.

 GALCON STUDIO, SL will operate its e-commerce business as a virtual store through the website . This electronic platform offers seven product lines, listed below:

  • Tops
  • Skirts
  • Blouses
  • Clothes
  • Spot
  • Pants
  • Outerwear

 

The marketing of products included in the above business lines is governed by the following General Terms and Conditions of Purchase.

GALCON STUDIO, SL may alter the design, presentation and/or configuration of the Website, as well as some or all of its services, at any time and without prior notice.

 

1.3.- Acceptance of the specific purchase conditions.

 

Access to and use of the service implies the User's full and unreserved acceptance of all the conditions contained in these General Terms and Conditions of Purchase. Furthermore, GALCON STUDIO, SL reserves the right to unilaterally modify these General Terms and Conditions. 

Any order placed with GALCON STUDIO, SL necessarily implies, as an essential, determining and indispensable condition, the unreserved acceptance by the customer of the General Terms and Conditions of Purchase of its products, in force on the day the corresponding order is placed. Furthermore, the customer acknowledges that acceptance of these General Terms and Conditions of Purchase will imply their application to the order to which they refer, as well as to any subsequent order, except in those cases in which new conditions are brought to the customer's attention by GALCON STUDIO, SL.

 The fact that GALCON STUDIO, SL does not resort to any of these conditions at any given time cannot be interpreted as, nor will it be equivalent to, waiving the right to resort to them in the past or future.

 

2.- ONLINE PURCHASE PROCESS.

 

2.1.- Our products, how to find them?

 

www.galconstudio.com offers you a virtual store that offers all kinds of products and services organized into categories, making it easier for you to find them.

From the home page, you can access all levels of product families. You can also find products at www.galconstudio.com through the search engine. Simply enter a keyword (which can be the product name, features, or even incomplete words) and click the search button.

 

2.2.- Product categories/families:

 

All products have a detailed product information sheet, which includes a photograph, the name, description, and price including taxes. The prices shown on the product information sheets are an invitation to the customer to place an order; therefore, if there is an error in the prices, GALCON STUDIO, SL will inform the customer of this circumstance and will not process the order.

 

Once the products are selected, they will be added to the Shopping Cart, where the user can add or remove products at any time. Once the product selection process is complete, or by directly clicking the "BUY" button, the visitor can complete the product selection process and proceed to checkout.

 

2.3.- Buy at www.galconstudio.com

 To purchase, users can register on our e-commerce platform by completing a user registration form, or without registering, by signing up as a guest.

To place an order through our e-commerce platform, regardless of whether you register, you must complete our form, providing us with the following information: 

  • Name and surname.
  • Complete postal address.
  • Email.
  • Contact telephone number.

In addition, registered users may receive information about offers and promotions if they wish, and learn about the processing status of their orders. Your personal information will be recorded in your customer profile, so you won't need to fill it out again for subsequent purchases. 2.4. Product availability.

The selection of products offered through GALCON STUDIO, SL is valid as long as the products are visible on the website. As this is an e-commerce operation, stock is updated online. Therefore, it may happen that stock runs out during the purchasing process, making it impossible to continue with the purchase.

The availability status of each product is indicated on the product information sheet:

  • Available in stock, dispatch within 24/72 hours. The item is in our stock, and we promise to ship within 24/72 hours.
  • Check stock. If stock is not available, delivery is subject to the part's production date for delivery. Customers will be informed of the order's availability within 24/48 hours.
  • Out of stock. The item is out of stock and we are temporarily unable to purchase it.

 

To these availability times, we must add the time it takes our transport operator, TIPSA, to deliver the merchandise. These times are calculated on business days (Monday to Friday, inclusive), since www.galconstudio.com does not ship on holidays, Saturdays, or Sundays. 

The shipping times indicated are indicative. In the event of a stock shortage or temporary unavailability of an item, GALCON STUDIO, SL will contact the customer immediately to inform them and provide a new delivery date or, if the product cannot be delivered, cancel it.

In any case, a delay in delivery compared to the indicated deadlines will not entitle the customer to any compensation.

 

2.5.- How is the order processed?

 

The purchase of the products must be made by activating the "BUY" button that appears at the bottom of the purchase request page, and expresses full acceptance of each and every one of these Terms and Conditions of Purchase, as shown in , prior to the purchase of the products.

When you click the "Process Order" button (after selecting the products and units), the registered user must enter their username and password. They will then be taken directly to a personalized checkout panel, where they can modify their shipping address and select different shipping methods and payment methods. If purchasing as a guest, you will be asked for your personal information to process and deliver the order.

 

 

2.6.- Prices.

The prices applicable to each product, which include VAT, are indicated on the product information sheet. During the purchasing process, the amount corresponding to the tax charge will be shown at the current rate applicable to the products and/or services sold, as well as the corresponding shipping costs, detailed before confirming the order.

Offers will be duly marked and identified as such, appropriately indicating the previous price and the offer price.

 GALCON STUDIO, SL reserves the right to make any changes it deems appropriate at any time and without prior notice, and may update its products and services daily based on market trends.

The corresponding shipping costs are always indicated in the order.

For shipments to countries outside the European Union, GALCON STUDIO, SL will not be responsible for any taxes or customs duties imposed by each country.

In the event of a price change, GALCON STUDIO, SL will notify the customer of the change by email, and the customer may choose to cancel their order without incurring any additional costs.

 

2.7.- Payment methods.

GALCON STUDIO, SL offers various payment methods so that the client can choose the one that best suits their needs:

 

  • Payment by Visa, MasterCard, and American Express credit cards , which have developed a system for secure online payments. The Secure E-Commerce system relies on the card issuer identifying the cardholder before authorizing online payment. GALCON STUDIO, SL reserves the right to reject any credit card transaction. In this case, we will refund the cash to the original card. In these cases, and if the customer is interested in proceeding with the purchase of the items, we will request a bank transfer.

 

If this is the payment method selected by the user, a secure connection is established via SSL [1] , where you must confirm the payment and enter your bank details directly. This page is not controlled by GALCON STUDIO, SL, but is an external payment gateway, so GALCON STUDIO, SL does not have access to or store your bank details.

 

  • PayPal Account : Secure payment system in which the user opens an account that subsequently allows them to make payments in a multitude of online stores around the world using their credit or debit card. PayPal will be the only party that will have the customer's bank details, acting as an intermediary between the customer and GALCON STUDIO, SL. Once the customer makes the payment, the payment is immediate. GALCON STUDIO, SL then receives it and begins processing your order (after verifying that the details are correct). To register or for more information, visit www.paypal.es, the PayPal website for Spain. These links are external and lead to pages with their own terms of use and/or privacy policy.

 

 

2.8.- Non-payment.

Upon the agreed delivery date, in the event of total or partial non-payment by the customer, GALCON STUDIO, SL may suspend or cancel any shipment, without incurring liability for any damages or losses, including loss of profits, or damages for delay or loss of production caused to the customer. The foregoing authority of GALCON STUDIO, SL shall, under no circumstances, release the customer from their contractual obligations regarding payments due and receipt of the products.

 

2.9.- Billing.

GALCON STUDIO, SL will be required to issue an invoice to those customers who request one. This invoice will include the itemization and details of the amounts received for the delivery of the requested orders.

 

2.10.- Transportation and shipping costs.

Shipping and/or handling fees are not included in the price and will be shown to the customer before completing their purchase, depending on the shipping address for each order.

 

For orders over €200, shipping costs are free. For all other orders, shipping costs include several flat rates:

1.- €6 shipping costs to mainland Spain.

2.- €12 shipping costs to the Balearic Islands.

3.- €17 shipping costs to the Canary Islands.

 

GALCON STUDIO, SL is not responsible for any delays caused by transport due to:

 

  1. Incorrect or incomplete address
  2. Not providing a contact phone number
  3. Carrier strikes and force majeure situations.

 

If the customer does not notice any external damage to the package upon receiving it, but upon opening it, notices damage caused by transport, they must notify the shipping company within 24 hours to record this and contact GALCON STUDIO, SL. Otherwise, the product will be deemed to have been accepted as compliant. After the aforementioned period has elapsed, the shipping company considers the merchandise shipped to be in perfect condition and is not responsible for any defects.

 

2.11.- Delivery of the products.

The products will be shipped to the shipping address indicated in the order. If multiple items are ordered with different availability, the shipping time will be based on the longest estimated delivery time. The courier service does not deliver on Saturdays, Sundays, or holidays.

 

Delivery times cannot be agreed upon. Delivery will be 2-3 business days after order placement for products available for immediate shipping and 3-7 business days for products not available for immediate shipping.

 

In exceptional cases, GALCON STUDIO, SL reserves the right to split the order, sending available items and holding unavailable items for a second shipment. GALCON STUDIO, SL will not ship any products until its Administration Department has verified payment.

 

In the event that the customer detects any problem at the time of delivery of their order (damaged packaging, defective, missing or damaged products), they must indicate it in writing on the carrier's delivery note and notify GALCON STUDIO, SL via email at info@galconstudio.com , within 24 hours of receiving the order.

 

No return of damaged items, nor claims for missing items, will be accepted if notified within the established deadline. This is without prejudice to the warranty rights for products that do not comply with the contract, which all consumers have, in accordance with current regulations.

  1. EXCHANGE, CANCELLATION AND RETURN OF ORDERS.

 

3.1.- Change.

The customer may change an order if it has not been shipped. Any changes must be notified as soon as possible by emailing info@galconstudio.com , indicating the desired changes.

 

These changes by the customer are not permitted when the product is custom-made, personalized, or following the customer's instructions.

 

3.2.- Cancellation.

Orders may be cancelled in whole or in part up to 48 hours before the scheduled delivery date. For any cancellation, please notify us as soon as possible via email at info@galconstudio.com. 

 

If the cancellation is made within the aforementioned period, no penalty will be applied to the customer. If the cancellation is made after the agreed 48 hours for receipt, the customer will not be able to cancel their order or, if applicable, will be required to pay a late cancellation fee of €6.

 

If an order is cancelled once it has been confirmed and shipped, the customer will be responsible for any shipping and handling costs incurred.

 

Cancellation of orders placed by the customer is not permitted when the product is custom-made, personalized, or made according to the customer's instructions.

 

As a result of cancellation with the right to a refund, the purchase amount will be refunded using the same payment method used for the initial transaction, unless expressly stated otherwise.

 

For credit cards, the amount will be refunded at the end of the monthly billing period. The exact refund date depends on the credit card agreement between the bank and the customer. Refunds via bank transfer will be issued within seven business days, or as otherwise stipulated by the bank.

 

Any difference in price between the original order and the modified order will be processed according to the procedure corresponding to the chosen payment method. Return and reshipping costs will not be covered by GALCON STUDIO, SL.

 

For its part, GALCON STUDIO, SL cannot replace a product or product model without prior consultation with the customer. If, for reasons beyond GALCON STUDIO, SL's control, delivery of the order is not possible, the customer will be offered the option of exchanging it for a replacement product with similar characteristics, and the customer has the right to cancel the order.

 

3.3.- Return of orders.

Orders may be returned within 14 days of the purchase date, and to do so the Customer must contact GALCON STUDIO, SL via email at info@galconstudio.com .

 

Conditions for return.

 

  • The product must be unused and returned in the original packaging, including all original tags and stickers. Modified products cannot be returned.
  • The customer must have the purchase invoice. If not, it must be registered in the GALCON STUDIO, SL database.
  • The customer must be responsible for return shipping costs, which must be paid directly to the shipping company upon collection. Any materials received freight collect will not be collected.
  • The item to be returned must be properly packaged for return.
  • Shipping costs for the order will not be refunded.

 

The following are reasons for returning products:

  1. If the product does not meet the specifications shown on our website. In this case, the product will be refunded, excluding shipping costs. This refund will be issued to the customer's payment method.
  2. The product may be defective. In this case, the product will be exchanged for an identical one once the returned product has been received. GALCON STUDIO, SL will cover the return and reshipping costs.

 

Once we receive the merchandise at our warehouses and verify that it meets the required return conditions, we will proceed to refund the purchase amount using the same payment method used.

 

4.- RIGHT OF WITHDRAWAL.

 

The customer has the right to withdraw from the purchase within 14 calendar days without providing justification for all orders that have not been custom-made or made according to the customer's instructions.

 

The withdrawal period will expire after 14 calendar days, starting from the day the customer or a third party indicated by the customer, other than the carrier, received the order.

 

4.1.- Products not subject to the right of withdrawal.

 

In the case of orders made to measure or under the client's instructions, section c) of article 103 of Royal Legislative Decree 1/2007, of November 16, approving the Consolidated Text of the General Law for the Defense of Consumers and Users and other complementary laws, will apply, which provides the following:

“The right of withdrawal will not apply to contracts that refer to:

  1. c) The supply of goods made according to the specifications of the consumer and user or clearly personalized.”

 

Therefore, in the case of custom-made products and/or products customized according to the customer's instructions, the customer may not exercise the right of withdrawal.

 

4.2.- How to exercise the right of withdrawal.

 

To exercise your right of withdrawal, you must send the withdrawal form, accessible in this section, to GALCON STUDIO, SL by any of the following methods:

To comply with the withdrawal deadline, it is sufficient for you to send your communication regarding the exercise of your right before the corresponding deadline expires.

 

In the event of withdrawal, all payments received will be refunded. However, the customer must bear the direct cost of returning the goods.

 

Payment will be made without undue delay and, in any case, no later than 14 calendar days after the date on which the customer notifies them of their withdrawal. The refund will be made using the same payment method used for the initial transaction, unless expressly agreed otherwise; in any case, the customer will not incur any costs as a result of the refund.

 

5.- GUARANTEES.

 

All products come with a two-year warranty from the date of delivery. This warranty does not cover defects caused by negligence, impact, misuse, or improper handling. Furthermore, the warranty is void if a purchase invoice is missing.

 

Unless proven otherwise, it shall be presumed that any lack of conformity that becomes apparent within six months of delivery of the product already existed when the product was delivered, except when this presumption is incompatible with the nature of the product or the nature of the lack of conformity.

 

The warranty will be void under the following circumstances:

  • Bumps and/or improper transportation,
  • Fault or negligence of the client or third party,
  • Incorrect use,
  • Damages resulting from force majeure.

 

6.- CUSTOMER RESPONSIBILITY.

 

The client undertakes to make lawful use of the Services, without violating current legislation or harming the rights and interests of third parties.

 

The client guarantees the truthfulness and accuracy of the data provided when completing the contracting forms, avoiding any harm to GALCON STUDIO, SL as a result of any incorrect information.

 

Likewise, you agree to facilitate delivery of the requested order by providing a delivery address where the requested order can be received during normal merchandise delivery hours (Monday to Friday, 10:00 a.m. to 1:30 p.m. and 4:00 p.m. to 7:00 p.m.).

 

Failure to comply with any of these General Terms and Conditions may result in the cancellation or annulment of orders by GALCON STUDIO, SL without prior notice to the customer and without entailing any right to compensation.

 

In the event that the shipment is rejected by the customer, GALCON STUDIO, SL will not refund the shipping costs, which will be borne by the customer.

Likewise, the information the customer can access through the Website may be protected by industrial, intellectual, or other property rights. The Company shall not be liable under any circumstances for any infringement of such rights that you, as a user and/or customer, may commit.

10.- NOTIFICATIONS.

 

All notifications, requests, petitions, and other communications that must be made by the parties in relation to these General Terms and Conditions of Purchase must be made in writing and will be deemed to have been duly sent by regular mail to the other party's address or email address.

11.- NULLITY AND INEFFECTIVENESS OF THE CLAUSES.

 

If any clause included in these Specific Contract Conditions is declared, in whole or in part, null and void or ineffective, such nullity or ineffectiveness will affect only that provision or the part thereof that is null and void or ineffective, with the remainder of the General Conditions of Purchase remaining in effect. Consequently, the clause declared in whole or in part null and void or ineffective will be deemed not to have been included.

 

12.- APPLICABLE LEGISLATION AND SUBMISSION TO JURISDICTIONS.

 

Purchases and sales made at The Company are subject to Spanish law.

 

In the event of any conflict or discrepancy arising in the interpretation or application of these contractual conditions, GALCON STUDIO, SL submits to the consumer arbitration system / to the Courts and Tribunals that, where appropriate, will hear the matter, and which will be those provided for by the applicable legal regulations regarding competent jurisdiction: in the case of final consumers, to the place of fulfillment of the obligation or to the domicile of the purchasing party.

 

In the event that the purchasing party is acting on behalf of a legal entity, both parties expressly waive any other jurisdiction and agree to be subject to the jurisdiction of the Courts and Tribunals of Madrid.
